The Rhode Island Lemon Law provides protection to purchasers of new cars who experience problems with their cars within the first year of ownership or 15,000 miles whichever comes first. Under the law, a new car will be presumed to be a lemon if it is subject to repair for the same defect or condition on at least four occasions or if it is out of service due to repair for at least 30 calendar days.
The relief that a consumer is entitled to in Rhode Island includes a refund of the purchase price less an allowance for use of the car up until the defect is first reported. Also, under the Rhode Island law a consumer can recover any finance charges paid in connection with the car. The law also covers light duty trucks and motorcycles.
In addition to the new car lemon law, Rhode Island has a used car lemon law. Under the used car lemon law, the selling dealer must provide a minimum warranty if the car has less than 100,000 miles on it at the time of sale.
Does My Car Qualify?
Another law that applies to car sales is a federal law called the Magnuson-Moss Warranty Act. This law is sometimes referred to as the federal lemon law. The federal lemon law applies to all vehicle sales that come with a written warranty. This lemon law obligates the warrantor to repair your car within a reasonable time. “Reasonable time” is not defined in the federal lemon law.
