The Illinois New Vehicle Buyer Protection Act protects purchasers of new vehicles. Under the Act, if the seller is unable to fix the new vehicle under applicable express warranties after a reasonable number of attempts, the manufacturer is required to either replace or repurchase the lemon vehicle.
Any action under the Illinois New Vehicle Buyer Protection Act has to be commenced within 18 months of delivery of the vehicle to consumer and there are two ways to determine that a reasonable number of repair attempts have been tried:
(1) if within one year or 12,000 miles (whichever occurs first after the date of the delivery) the same nonconformity has been subject to repair 4 or more times and such nonconformity continues to exist; or
(2) if within one year or 12,000 miles (whichever occurs first after the date of the delivery) the vehicle has been out of service by reason of repair for a total of 30 or more business days
What About the Federal Lemon Law?
